Even if they rule the mandate unconstitutional there is still the severability issue. I think the reason the Obama administration didn't want the entire appeals court to hear the case was the severability question. The three judge panel held it was severable. It is my understanding that most of the law would still be in effect even if the mandate was thrown out. Of course it would result in even bigger deficits. But I doubt that would bother either of you.
