Senior found freezing in couple's garage


Kwong Yan on Tuesday pleaded guilty to one count of failing to provide the necessities of life. (Alex Tavshunsky/CBC)A Toronto man accused of forcing his elderly mother to live in a freezing garage in the winter has pleaded guilty to failing to provide the necessities of life.

Kwong Yan's 68-year-old mother was found unconscious and suffering from frostbite in the uninsulated garage of his Scarborough home in February.

His lawyer said on Tuesday at the Ontario Court of Justice that the garage had been set up as a simple apartment and efforts were made to provide heat.

Justice Timothy Lipson described the case as one in which the mother was "long revered by her son who did the best to make her comfortable despite her frailties and medical problems but on one isolated occasion failed to provide the necessities of life,” the Toronto Star reported.

Both Yan and his wife Qi Tan were originally charged with failing to provide the necessities of life and criminal negligence causing bodily harm.

Those charges were dropped Tuesday against Tan. The Crown also dropped the criminal negligence charge against Yan.

The Crown and defence agreed on an eight-month jail sentence for Yan.
