SNY couldn’t care less what the Judge in the MNTA v. Amphastar case thinks about the AG launch because SNY is not a party to the litigation. Hence, any assurance that the AG has been “suspended” is meaningless except to the extent that it signals SNY is behaving rationally and wants to maintain duopoly pricing stability. We’re on the same wavelength vis-à-vis the NVS-MNTA “hybrid” profit-share arrangement. MNTA has made it crystal clear that it will not revert to the pre-AG formula, so it’s very silly for anyone to think that it will.
