You are correct that NASDAQ has tightened their rules. However, ATEC, with the guidance of their SEC attorney are well aware of the guide lines and have COMPLETED the application. I did not forget anything, on the contrary I believe that most people understand the company does not arbitrarily apply for NMS listing WITHOUT the guidance of legal.
