Rex, great post. I believe you are correct that they took advantage of loopholes to get the spinoff done. I see the pension fund like an investment account and assume they should know the balance of their assets at any given time. superficially they should have known about the shortfall on 9/30/11 already, theft they were representing stale numbers as late as 10/25.

I think the accountants and the management that facilitated this including the CEO of XYL should get their ass sued.
