With just 10 days to go until the law was scheduled to take effect, U.S. District Judge Richard Mark Gergel granted a motion that Obama's own Justice Department made . It doesn't get any more incestuous than this. The ruling applies to portions that require law officers to check the status of anyone they stop for something else and suspect is in the country illegally. Gergel also halted the implementation of sections pertaining to the transportation of illegal immigrants and immigrant registration cards. One provision was left intact: mandating business use of the Federal E-Verify system to check employees, and tough employer sanctions for failing to do so, or for knowingly hiring illegals. Those same provisions in an Arizona law were also fought by Obama in 2009, but the Supreme Court upheld them last Spring. The ruling goes against the decision by Alabama U.S. District Judge Sharon Lovelace Blackburn in September, to uphold similar provisions in Alabama's immigration law, and makes more clear than ever why Arizona's S.B. 1070 must be upheld by the Supreme court when it is heard next summer. Gergel has denied the state's request that he suspend all court hearings on the case until the U.S.Supreme Court rules on a challenge to Arizona's similar law. South Carolina prosecutors have said the nation's high court will likely rule in six months or less. Governor Haley, through a spokesperson , said she will not give up the fight : "If the feds were doing their job, we wouldn't have had to address illegal immigration reform at the state level. But, until they do, we're going to keep fighting in South Carolina to be able to enforce our laws ....[I am] hopeful that the U.S. Supreme Court will soon do what Congress and the executive branch have failed to do, which is allow the states to pick up the slack where Washington has failed."
