This is a Benen piece from about a month ago that is relevant to the recess appointment "controversy." I put the word in quotes because the real controversy ought to be the fact that the Republicans essentially want to govern as a minority by abusing the powers that minorities have been given. They complain about lack of precedents; well, their behavior over the past 10 years has been outrageous (yes, I mean 10, essentially since Bush took office). Their myriad holds on judicial and executive appointments and their filibusters during the Obama administration are what is without precedent and demand a response. And they badly abused majority power when they were in the majority.

I agree, Sam, and, at first, I thought the Obama folk were going to campaign on that point. But, at least as of this evening, they are campaigning on the Reps as Wall Street agents trying to block Cordray because the agency would help Main Street. Probably a better campaign poster than recess appointment arcania.

Technically, Senate is still in session. Obama forgot to adjourn it. I expect a court fight that he will lose.
