I'm convinced that Bush,and now Obama, have told their advisors this is what I want to do. Find me a legal rationale for it.

I'm also convinced that this is what the Supremes do more or less. There's enough instances where the Court has departed from precedent to accommodate updated facts or cultural "evolution" to make an argument about it.

So you may think it is "silly" to talk about judicial/political bias in this context, but Sup Ct. watchers do it all the time--as well as legal scholars.

After all what is bias but a point of view, and a lot of constitutional decisions turn on that.
