That would depend how they are shorting. Declared shorting, done by borrowing shares from another firm and with that firm's approval, is perfectly legal. Undeclared shorting against "phantom" shares is illegal but apparently not often enforced by the SEC. Don't know how many shorters there are out there nor of what type, but if you find one roach there's usually more. TraderGreg All very quiet at 1.27 x 1.30 and oops...ask at 1.32. Fasten those seat belts.
