If Intel and Cyrix have an effective cross-license agreement by virture of Cyrix being acquired by NSM (with which Intel does have some form of such agreement), it would not necessarily be grounds for complete dismissal of the suit. NSM/Cyrix would still possibly be able to collect for damages on Intel's sales violating Cyrix's patents during the period prior to Cyrix's acquisition by NSM.
