It wasn't the permit application that DEC took issue with but certain aspects of the design.

The design drawings were submitted to DEC for inspection. DEC didn't like some things and suggested other ways to accomplish the same task. There was a back and forth discussion on those items that ultimately resulted in design changes that were acceptable to both JBI and the DEC.

The willingness of JBI to listen to DEC and work with the DEC to arrive at mutually acceptable changes is a big reason that DEC said it had a good working relationship with JBI.
