Very much. I'm sure Scalia and Thomas also think it was bad (which isn't very relevant to the issue of the proper powers and responsibilities of the courts, but seems to be what you care about).

People aren't perfect, so injustices will happen. Judges are people as well, and so they are also imperfect. You can't end imperfection and injustice by concentrating more power in one group of people, because those people will also be imperfect, and sometimes unjust.
