For such a low royalty, about 4%, or maybe 5%, it's probably not worth bothering to avoid Qualcomm's patents. OFDM was a worry, but with the Flarion purchase, that didn't cause a very large problem, though the LTE conspiracy succeeded in keeping the extorquerationate GSM Cartel royalties running while Qualcomm's cheaper but better pure-bred technology was ditched.

Using pulsed neutrinos is the way to go because then trees, buildings and even mountains wouldn't block the signals. High frequency trading computers could have line of sight to win the race to the exchange. Even right through the middle of Earth wouldn't be a problem and avoid having to lay fibre all over the planet. Producing the neutrinos and collecting them again, and sending them in the right direction might be a bit tricky. But Irwin Jacobs was reading The Elegant Universe a decade ago so he might be "retired" but really working on that next big thing.
