What also gets lost in these kind of discussions is "culture". The culture defines the boundaries of these kind of laws, and black and white positions based on philosophy often don't provide a clear answer. As the cultural norms change, so do the laws when the majority of citizens change their cultural way of thinking.

But if it's the constitution that's the reason why there can't be any public nudity or obscenity laws, that overrides state and federal laws. Invoking the first amendment means the state-federal distinction doesn't matter.
