The key thing is that it is NOT ILLEGAL in the commodities business to use customers funds for this purpose (this rule is now being reviewed by the SEC). So even if Corizine did instruct this transfer no legal wrong has taken place----as far as I know.

Additionally, the word "misuse" here gives Corzine a legal out with regard to his testimony before congress, if I've understood the law correctly.

Of course in the court of public opinion he's a loser.

I never said all. Just the clearly criminal. Most of the TBTF bankers are criminals and could easily be prosecuted under SOX compliance rules alone. But we're too concerned about "moving forward" instead of "prosecuting the past". It's one of the fundamental problems I have with this administration. I believe in a President who upholds the law through vigorous prosecution. I'm not interested in moving forward and burying the past. That usually leads to repeating the same mistakes, because we never hold accountable those who were responsible for the disaster.
