I'm very worried about Kennedy's questioning about the insurance industry being sufficiently unique. Kennedy may try the "highly regulated industry" "limited holding" cop out. Kennedy could hold that insurance is a highly regulated industry that is sufficiently unique to warrant a unique regulation such as Obamacare, upholding the law, but copping out that his holding only applies to this one unique situation.

This would be equally disastrous as just saying the Commerce Clause is unlimited. This would just open up the floodgates for the government to argue this and that are also unique industries warranting unique regulation. It would never end.
