Of course. Being attacked just shows he was prudent to have armed himself.

Assuming he was on the bottom in the fight and took some punches and even head banging.....where was shooting justified....was he being beaten to death if he was being beaten at all....?

Ah, I see your logic. He should have waited till he was dead to defend himself.
