Yes, I agree. And several commentators have noted that. Alito actually asked the better question, which was funeral insurance. Since we will all have funeral expenses, can the government require that we take out funeral expense insurance. I think the answer to that is obvious. If you don't have funeral insurance, the general public will not wind up paying for your funeral. Only the disposal of your body. Which is not a funeral problem. But, apparently, the government rep wasn't up to handling this level of argument.
