You can't be suggesting that all proposed legislation and policy first be cleared by the SC, are you... That's the typical response of a bureaucrat. If someone sues over it, it moves through the court system, and the Supreme Court grants certiorari, you're damned right. Regulations and policy can be unconstitutional and if they are they must be stopped. If the Treasury department promulgates regulations that say IRS agents can burst into your home and search it for cash, you think that would be okay?
