I wouldn't call it toothless, but lets say it is. That fact wouldn't be relevant. Toothless, or ruthless and powerful, would change the point that a higher than market clearing price would generate surpluses.

Its not a matter of regulation, or lack of regulation. The CTFC could be non-existent or it could be a totalitarian dictatorship knowing no limits on its power, and it wouldn't change a thing about the point in the last paragraph. Its a matter of basic economics. Regulation could destroy the market, but assuming it didn't, if the prices go to high surpluses will be generated. Nothing the CTFC could do, toothless or powerful, would change that.
