Conservative or not, there is one question that pervasive: If the Court allows the "ACA" (the title is a joke) to stand, why is it not then possible and completely legal to force 20 year olds to buy burial insurance?

That is an important question, because it is a precise analogue. And it is even more absurd. Yet, if the Court doesn't block ACA, there is absolutely nothing to stop an overzealous Congress from doing just that.

If the ACA stands, there is literally nothing our Constitution of "enumerated powers" prevents Congress from doing. And it would undo all precepts of separate of powers.

I just don't think they can look past it.
