I would say that anyone (of normal IQ) would agree that, if that allegation I quoted above which is lifted from your post is proven true, then the black firefighters have a point.....it is manifestly unfair and would explain the disparate impact on the black test takers....just as a matter of basic fairness.

I don't think that was Holder's point....you have misstated as you usually do.

BTW, I don't agree with the holding of the USSC in the disparate impact line of cases which is the line of attack here in this case....its too subjective in my opinion........but it is the law until changed.
