The settlement was less than the back rent. I don't know what the attorney fees were but they were still probably much less than the future rent that NOVS didn't have to pay.

Call the settlement lack of credibility - o.k. Others might refer to it as a business decision and the plaintiff agreed to the terms.

HRB kept originating loans long after NOVS. The lawsuit against HRB deal with HRB knowing that it would not be able to repurchase loans while it was still putting together securitizations. Making that same case against NOVS would be much harder to do.
