Nonsense.

Issue of theology = religious issue
issue of prayer or worship or religious practice = religious issue

Belief in a human right and that it should be protected by law != religious issue

Both religious and non religious people can and do take both sides of the abortion issue. It has nothing to do with prayer or worship or religious practice so by definition its not a religious issue.

And should you redefine religious issue to include any issue that religious beliefs have an impact on then

1 - Most issues then become religious issues, and many issues are strongly so (for example the opposition to slavery was heavily religiously motivated)

2 - There is nothing against the letter or the spirit of the constitution with legislating religious issues. The constitution outlaw establishing a religion or prohibiting the free exercise of religion, not with being inspired by religion to try to outlaw slavery or abortion or other things.
