The claim is that the company knowingly over-projected sales based on their PIII trial results and market assessment. The question at hand is; when does the protection provided to forward looking statements under 'Safe Harbor' end and a fraudulent projection begin. Doubt the case will go far, Safe Harbor turns out to be a pretty generous umbrella.

Best bet would be if someone disclosed internal documents indicating that clinical advisors and validated econ models fell well short of the descriptive phrases used in PR and other public documents. Otherwise, projections are just projections, not facts...buyer beware
