AVNT/CDN. No reason for CDN to back down. Think about it. They're legal bills are what $1-3mm/yr. This is one of the best marketing tools CDN could have. Does anyone know where the hearing will take place (Santa Clara, San Jose?)? Maybe I'll go take a look.
I found CDN quote of the Appellate Court's ruling very interesting (as well as completely nebulous, similar to most of both CDN/AVNT PR in this case): "If the Aquarius software infringes CDN's copyright, the district court should have entered an order enjoining AVNT from selling the software". No $#%@! Unfortunately, discovery proceedings never took place on Aquarius the first time around. Judge Whyte only made a statement w/regard to AVNT's clean room procedure which according to a lawyer friend of mine could be a "trade infringement" violation not a copywrite violation. None of my lawyer friends could sight a case where a product was enjoined for trade infringement. Does anyone out there have any case history on this subject? This looks to me like it will drag on for awhile. IMOO.
