Foreigners registering US patents is different than the US government selling patents that belongs to the American people to a foreign entity.
1. The Bankruptcy Court would be the one approving any sale;

2. How do you arrive at the conclusion that the American people own the patents?

US government selling patents that belong to the American people

Any patents Solynda had do not belong to the American people, they belong to Solyndra. Since it is in bankruptcy, it is the responsibility of the bankruptcy trustee to get the maximum value for the assets to repay the creditors, including the US govt. If those patents are vital to US interests, than the govt should bid for them.
