California wouldn't be setting a higher standard for use by requiring a labeling disclosure. It's a hard argument to assert that if people knew what was in it they wouldn't use it and therefore the state was contravening the FDA's approval of its use in a food product. Ed

I, myself, think the state can't "usurp" federal labeling regulations with their own criteria without running afoul of the Fed's right to regulate interstate commerce. Of course this is an unresearched off the top half hearted legal opinion (because I don't want to do the research) and you are free to educate me to the contrary.
