<<<On May 31, 1995, Digital Biometric, Inc. ("DBI"), a competitor, filed a
lawsuit in the United States District Court in Northern District of California
against the Company alleging that certain of the Company's TouchPrint products
violate a DBI patent and seeking injunctive relief and unspecified damages. The
lawsuit has no implication for other Identix products. On August 22, 1996, the
Court granted the Company's motion determining that TouchPrint 600 does not
infringe the patent. On December 7, 1996, the Court issued another ruling
determining that the predecessor product of the TouchPrint 600, the TouchPrint
900 product, did not infringe the patent. As a result, the Court entered
judgment in favor of Identix and awarded Identix its cost of suit. On January 7,
1997, DBI filed a Notice of Appeal. Oral argument on that appeal was held before
the Federal Circuit Court of Appeals on October 8, 1997 and the matter is under
consideration by the Court.>>>

The above is fact, the rest is rumor. The Touchprint 900 hasn't been sold for years. I don't think the risks and potential impact are significant

Spindizy's credibility -

Spindizy attempted to spread false rumors about Identix almost a year
ago. He made disparaging remarks about Randy Fowler and tried to cast
doubt on the strength of the IDX/NEC relationship among other things.
Spindizy was descredited by Porsche770 and slithered back into the
shadows. I am very skeptical of anything the Spindizy says.>>>

Brutus......It is not IDX4EVER's job to educate you on the facts and issues surrounding Identix...If you would do your own homework....you would not be short this stock, but this would not be in keeping with your personality traits..... So continue to keep your head in the sand....short the stock.....and be happy. Anything that you might learn from IDX4EVER is just going to ruin your day.

Mbenz,
Insiders sell for many reasons.....one insider selling means nothing! They buy for only one reason...they think business is booming. I suggest that we stop paying attention when one insider sells....it only means something if most or all of the insiders are selling...and selling very large positions. This is not the case. It is Christmas you know...maybe Dan is buying his wife a new house
and diversifying the rest of the funds in the market....a prudent move on both fronts.

We could be seeing some tax loss selling from the holders that bought in between $12-13 earlier this year. Do not let it get to you. Remember one very important fact...When Identix stock is rising...it does so on greater volume.....When it is falling...it does so on very thin volume....this is very BULLISH. Do not loose sight of your long term goals...based upon short term moves.

I bought a couple hundred shares @ 16.25 during that explosion period and bought a couple hundred more shares @ 7.50 during the deplosion period. And am holding both buys for at least 2 more years. You won't see my shares on the market. I only believe in selling a loss if the company, in my figuring, will not double for me in 3 years and I believe IDX will by 1999.

Pay attention everyone, remember DBII, now $2 per share, I remember it at $10. Also national registry, now 50 cents per share..............Ask yourself honestly what might IDX's fate be now that you are witnessing the demise of some of the other pioneers in the field. The big boys are in this business now, whats left for these little guys.....

Be careful with Porsche, IDX4Ever and the other touters, for all you know they may work for IDX or have some other vested interest in the company that causes them to be so blind... Obviously with a name like IDX 4 EVER---this is not an objective person. Hey it's your money and nothing is 4EVER, be careful, the obvious sometimes is usually right in front of you, just
open your eyes.

Good luck........I will now leave this board and shall not post here anymore.....I can only leave you with this warning and Motley Fool will also warn you,,,,,,WATCH OUT FOR TOUTERS AND STOCK PROMOTERS.

You guys are so busy calling each other names, its no wonder there is no mention on this board of 1) Needham initiates coverage of IDX with a BUY recommendation and 2) Clinton has signed the INS funding bill.

As for Lockheed Martin, I am not sure what Rajun R. means when he says "LM is a friendly partner with NEC and Identix." What I have read in the various companies' press releases is that NEC and Lockheed Martin have signed a joint venture agreement to cooperate in in certain areas of marketing and manufacturing automated fingerprint identification systems (which does not cut into any IDX business since IDX does not make AFIS systems); and that
IDX has been a large supplier (formerly their ONLY supplier) of fingerprint readers for NEC systems; and that IDX and NEC have recently signed an agreement regarding IDX supply of readers for NEC's recently unveiled state of the art AFIS. So when Brutusone says "With Lockheed and other big players like this in there whats left over, " I get the impression that he does not fully understand the products, the market or the relationships between the
parties. I for one do not believe that IDX is getting left out in the cold as Brutusone's comment suggests.
On the other hand, as I have said recently, I also am beginning to think that the impending explosion of IDX stock mah not be so impending. As reported today in DOW Jones, Needham initiated coverage with a buy. But look at their EPS predictions:
FYE JUNE 98 .13 cents
FYE JUNE 99 .28
FYE JUNE 00 .40
12-18 mo target of $16
Even Jeff Kessler of Lehman changed his .40 EPS estimate from FYE JUNE 98 to FYE JUNE 99. Saloman initiates coverage this week with a buy and a twelve month target of $13. Now, I am not one to always (or even often) put stock in an analyst's or a broker's recommendation, but, the estimates in the past surely have not been conservative. IDX never beats Kessler's prediction. Of course, if we do get all $23 million in livescan orders from INS this
year, we would certainly beat everyone's predictions and probably take a ride (for a while until the one-time nature of that really big order is digested.

So, what am I saying? This is investing. Who knows? But IDX sure seems to be a big player.

See my next post for the INS story.
