About 6 years ago I met a senior lawyer in the Justice Department. He had a few beers and told me how the SCOTUS really operates. He told me the individual justices make deals on decisions with the WH, then hand off the work to clerks to write the opinions to defend those decisions. He said the court will trade results for the WH Solicitor General in cases important to the WH in exchange for latitude in decisions in cases important to justices. He was emphatic about the cutting deals aspect.
