this NONSENSE tax scheme is enshrined as constitutional ....so we are at the whim of congress and the president on being taxed for BEHAVIOR....

Purely as a tax scheme it is functionally equivalent to hiking the tax then giving you a tax credit if you fulfill some condition, which was constitutional before. The pernicious change is that now the condition comes first, and the tax becomes punitive.
