President Romney can refuse to implement it
That is good for at most 8 years. As bad as the law is, the bigger danger is that it reinforces the idea of unbounded Federal authority. Only the court can undo that.

I think the chances for a Republican Senate just went up sharply. Remember how the Democrats used reconciliation to help pass this. Also, President Romney can refuse to implement it, just like Obama wrote new law via the EPA.

Yup, Obama has set a lot of precedent. How about the selective enforcement of immigration laws? When the republicans are in control it will be time to selective enforce other laws on the books.
