And its not just legal scholars and commentators, none of the lower courts accepted the tax argument, and as you point out, only Roberts did in this decision.

We weren't discussing if the tax issue applies to the penalty, we were discussing if Congress has the power to levy this particular tax (on the presumption it is a tax as Roberts concludes). And yes they do, as I demonstrated to you and as everyone has conceded forever. Congress has the constitional power to take virtually everything you own as a tax.
