as usual with him, he was probably more interested in avoiding a 'confrontation' with the opposition and believed a justice without a record on the court would be easier to get the chief justice nomination

imagine the attack on him had he appointed scalia or god forbid thomas

Chief Justice has to be confirmed by Congress whether they are already on the Supreme Court or not, but I do wish Thomas had the job.
