You're right, they can point to that opinion now as precedent that a penalty and a tax are the same thing. The power to penalize is a general police power. That is the real danger IMO. I think you know more about this than I do, but it appears that the dam that has long shut back the Feds from exercising general police powers has just been broken.

I disagree, the word 'tax' is a hated word, congress hates to pass anything with the word tax added to it, that's why obama said it was a penalty.

the dems pass everything using the commerce law and the people don't care. Roberts sorta nipped that in the bud
