The word penalty shows up in the law 18 times. It is never once called a tax. If its a tax, you call it a tax and save 4 letters 18 times. But they didn't do that, because they were trying to expand the commerce clause to anything they want. But now, they can tax you for not exercising, not eating broccoli and not bowing down and praising Obama's name.
