The law does not equal semantics. It is a HUGE difference to equate a tax with a penalty. The taxing power is to raise revenue. Alcohol taxes and National Firearms Taxes and Cigarette Taxes aren't punishments, they are for revenue. Penalties are for crimes, not legal, free behaviors. If a tax is the same thing as a penalty, then taxes can thus be raised on anything to ban/prohibit anything at all. You won't understand this until you yourself are taxed/penalized for not being able to score higher than 95 on an IQ test.

A very real lesson....

The Food Stamp Program, administered by the U.S. Department of Agriculture,

is proud to be distributing the greatest amount of free meals And food stamps ever.



Meanwhile, the National Park Service, administered by the U.S.Department of the Interior, asks us to

"Please Do Not Feed the Animals."

Their stated reason for the policy is because the animals will grow dependent on handouts and will not learn to take care of themselves.
