If Roberts had driving the commerce clause back further rather than just stopping a pretty clear advance to no limits on its power, I'd say yeah that was a victory. All Roberts did is stop the clause from being used as the power to take it to the realm of the ridiculous; Govt power over non economic activities or non activity at all. The power to regulation anything and everything. They need to drag this pig back into to court to have it struck down as an illegal tax based on the Anti Injunction Act and Constitutionally as an Illegal Direct Tax without Apportionment among the Several States. Roberts has now made it lawful for Govt punishments to be doled out to criminal behaviour as taxes. That used to be a general police power the Feds didn't have before. Now they have their foot in the door to general police powers. That is nothing to celebrate at all.
