Maybe, but due diligence should mean more than, "They told me it was so."
I'm not sure what kind of due diligence would have prevented this. Apple's people did research into who owned the trademark, I'm sure, and did business with Proview's Taiwan branch in good faith. Proview China was under pressure and on the verge of bankruptcy. I believe they saw an opportunity for a shakedown and went for it. They got as far as they did because they had the home field advantage, in my view. The Chinese courts are not exactly a level playing field where intellectual property is concerned.
