1. There is been no evidence, whatsoever, that anyone "erred" at all; and

2. It is a crime to overstate your tax liability intentionally just as it is to understate it. While civil penalties focus on understatements of income, a person who submits a tax return that overstates his income is guilty of misstating income just as is the underreporter.
