I think there would still have to be a trial on the merits of IOM's claim that Nomai is infringing on its patents. If there are found to be doing so, they'd either have to come up with a new non-infringing design or be permanently restrained from selling in the U.S.

Isn't there a hearing this morning in Europe on another IOM - Nomai dispute? I will look to see if there has been any ruling issued. I personally will feel much better once these toads are hogtied everywhere.

[ 5 minutes later] Can't find any news about a bench ruling. It'll probably be taken under advisement and ruled on at a later date.
