I think a couple of things remain to be seen:

Viruses

And their follow through.

MSFT has kept their head down and plowed through with a very good Windows 8 product. They took their time to develop their new system without any patent infringement.
One thing I should note is that Apple and Microsoft have a longstanding agreement about user interface elements, which means, among other things, that the Surface can use all the gestures from iOS without infringing any Apple patents.
