As best I can tell, Delphi's unions bargained a pension backstop from GM well before GM's bankruptcy, and GM did not try to break any of their union contracts as part of the reorg. And as best I can tell, Delphi's non-union employees did not have any backstop guarantees, so they got what Delphi's bankruptcy process and PBGC guarantees provided to them under the law.
