Roberts sided with Heller and Scalia in the opinion in that case saying the 2nd guarantees an individual right and that it is unlawful to ban an entire class of firearms. EO can only allow changes to regulations within existing law including the Heller decision. ATF can say high cap mags aren't sporting and can't be imported. So what. They can't ban them by EO period. There is no law to back up such a regulation.
