E!

Don't feel bad I was included in SUNW, ORCL, BJICA, ADM and some others I can't even remember at this time...too painful

...But... you do not have to do anything b/c the lawyers will contact you thru your brokerage house. Then they will have you fill out forms stating when and how much you bought and sold...and fortunately you can do it in the privacy of your own home so no one knows how silly we were to sometimes get taken in by companies and their officers statements and lack of them,<G>

BTW, what happened to the LSI volume today...probably, still the Tom Kurlak cloud hanging over some potential buyers...soon they will all learn he is just a hoax!!!

I still think 27 by Dec 17.:-) Well ..would you believe at least by 1998 :-)

What do you think?

Good Luck Trading

E!, PMFJI, but I have "participated" in a couple of these suits.. and have come to the conclusion that they should be banned!.. OR, if not banned, the initiating lawyers should be required to stand in front of a steel wall, in a large stadium peopled by investors/employees/Officers/Directors of the company, all equipped with their choice of Uzi's, flamethrowers, hand grenades, bazookas, napalm, or anthrax canisters.
Let's face it, these legal sharks are compensated (highly)for striding out upon the battlefield after a disaster has decimated the troops, and bayonetting the wounded. Those who participate, to give validity to the sharks' charter, are permitted to take home token locks of hair, stripped from scalps torn from the heads of the bayonetted wounded. But perhaps I understate the case... reality is probably a bit worse. Duane

Hey E!!!!

Re: ASND class action suit. When I said I was a part of it I meant your first guess - fall within the class action suit dates. (I bought June and July I think but not many shares so que sera sera... - not too concerned if all the investment goes to the depths of hell...) This simple boy does not go the option route. "Generally" I do not bet on lawsuits because I can't put a monetary value on the outcome. Shareholder lawsuits are a slightly different beast though. I do not know the degree to which to blame ASND management. I think the networking business is marked by a lot of "turns" business and with the amount of backloading in customer orders these days it is difficult to predict the current q revenue. That being said, ASND should have disclosed the 56K Flex problems and the TNT problems earlier. Maybe they were purposely being evasive and as the lawsuit implied they may have been hyping the stock so that Cascade could be "bought with expensive stock". Which would mean they are in big trouble.

This is going to take some time to clear. Generally I think the deal is that the company makes some kind of cash settlement based on the timing of the shares purchased. In other words if you bought the day after the company said "ASND will soon rule the world" and it later turned out to be balderdash and the stock plummeted you will do well in the settlement. I think. Maybe they'll issue us free shares!!! (in a company that's hurting - how much are these shares worth! Or maybe cash and shares). I'm guessing. Hate lawyer types... - dishonest. Anyway if settled it's going to cost ASND and that will be reflected in a lower stock price all else being equal. Of course I'm hoping that they've got their act together and business, esp. international, starts taking off.

See maybe LSI is wise to keep its mouth shut re: business conditions. Actually I think their keeping quiet has to do with the volatility of their business and the fact that predictions of upswings can turn into downswings (don't we know it). They have not had any shareholder lawsuits ever (I think) and this may be why. In spite of being one of the highest beta mid-cap stocks.

RE: contest. I think it's a great idea. I do not have any shares in LSI so monetarily the share price fluctuations do not affect me one way or the other. Still now I watch the share price "like a hawk" (to steal Quote.com's phrase).
