The two men fled the apartment. Nothing was taken and no shots were fired. The rifle was not loaded at the time of the home invasion, according to Raymond. "They decided this place was a good place to rob, just a wrong decision on their part," Raymond said. "I'm happy he saved my life. I was very thankful he had his (gun)," said Boise. Raymond, who is from New York City, said he uses the rifle for sport shooting at local gun ranges. "The weapon was legal and he protected his property, said Rochester Police Chief James Sheppard. The incident unfolded Sunday afternoon, after three pit bulls attacked an 11-year-old boy as he rode his bicycle through the Brightwood neighborhood of Northwest, according to a police report. When the man, a neighbor, saw the boy being mauled by the dogs, he went inside his home and got a gun. The man killed one of the dogs. The gunfire attracted the attention of a police officer in the area near Eighth and Sheridan streets, where the attack occurred. While public opinion might be supportive of the man’s actions, he could still face significant charges depending on the outcome of the investigation, criminal defense attorney Daniel Gross said. “I’ve seen cases where people used weapons in defense of others, but the U.S. attorney’s office is not always so understanding,” said Mr. Gross , who represents many clients charged with firearms-related crimes in the District. “There are certain defenses one could try, like self-defense or defense of others, but that wouldn’t really go to whether they charge you.” The man could face a host of charges depending on the specifics of the case, including whether the gun used is a registered firearm that the man was legally permitted to own, Mr. Gross said. Possession of an unregistered firearm or ammunition is punishable by up to one year in prison and a $1,000 fine, and determining whether the man legally possessed the gun used will likely have greater bearing on the way the case is handled, Mr. Gross said. Low-level unregistered firearms and ammunitions charges generally are prosecuted by the D.C. office of the attorney general, but additional charges could mean the case is bumped up to the U.S. attorney’s office. “In this case, it would likely be the U.S. attorney’s office, and their discretion is sometimes less than local prosecutors,” Mr. Gross said. Also to be taken into consideration is whether the man was within his property line when he fired the weapon — a small but significant distinction. The District may elect to not press charges, but given their past track record of harassing otherwise law-abiding citizens , it's not likely. Just ask James Brinkley. From Washington Times columnist Emily Miller's January 4 story (emphases mine): On Sept. 8, Mr. Brinkley says he intended to drop his wife and young children at the White House for a tour and then head to a shooting range to practice for the U.S. Marshals Service test. Just like Mr. Gregory , Mr. Brinkley called MPD in advance for guidance on how he could do this legally. Mr. Brinkley was told that the gun had to be unloaded and locked in the trunk, and he couldn’t park the car and walk around. Unlike Mr. Gregory , Mr. Brinkley followed the police orders by placing his Glock 22 in a box with a big padlock in the trunk of his Dodge Charger. The two ordinary, 15-round magazines were not in the gun, and he did not have any ammunition with him. As he was dropping off his family at 11 a.m. on the corner of Pennsylvania Avenue, Mr. Brinkley stopped to ask a Secret Service officer whether his wife could take the baby’s car seat into the White House . The officer saw Mr. Brinkley had an empty holster, which kicked off a traffic stop that ended in a search of the Charger’s trunk. Mr. Brinkley was booked on two counts of “high capacity” magazine possession (these are ordinary magazines nearly everywhere else in the country) and one count of possessing an unregistered gun. Despite the evidence Mr. Brinkley had been legally transporting the gun, his attorney Richard Gardiner said the D.C. Office of the Attorney General “wouldn’t drop it.” This is the same office now showing apparent reluctance to charge Mr. Gregory . Army veteran Mark Sikes of Bogart says he pulled out his pistol as soon as he heard his front door coming down. The hoemowner fired a shot at the intruder, striking him in the arm. The suspect then fled the scene, but was captured by police after a brief manhunt. The homeowner was taken to the hospital for treatment of the injuries he sustained in the assault. The homeowner had to be airlifted to a second hospital for head injuries. The suspect is charged with 1st degree assault and 1st degree burglary. We wish this brave homeowner the best in his recovery. We are also glad he was armed or this story could have turned out very differently. No matter how you cut it, an 82 year old is almost always no match for a 30 year old male in good shape in hand to hand fighting. At that time, the boy was babysitting his younger siblings, ages eight, 12 and 12. The incident started with a woman ringing the doorbell to the residence. Since the boy didn’t recognize the woman, he refused to open the door. A short time later, the boy heard a loud bang, which he correctly assumed was someone attempting to force entry through the door. The boy gathered his siblings and hurried them upstairs as he armed himself with a handgun from his parent’s bedroom. From the top of the stairs, the boy saw a man break open the front door. When the man pointed a gun at the boy, the boy shot the man. The man did not fire his weapon. The man was subsequently transported to a local hospital in extremely critical condition. Since the shooting, the man’s status has been upgraded to critical and he is expected to survive. The man, whose identity has been withheld, can look forward to being booked into jail on charges of aggravated assault and burglary. The woman who rang the doorbell remains at large. FOX 10 News – Phoenix, AZ | KSAZ-TV Phoenix Police Officer James Holmes praised the boy’s actions and his parents for teaching the boy not to open the door to a stranger. “The police and indeed our community does not ever want to see a situation where a teenager of that age has to take a weapon to protect his family … but this young man did exactly what he should have done,” Holmes said. “I’m not sure he gave full thought about what he had to do. He just acted.” Holmes summed up the incident by saying, “As ugly as this is, and as much as this family is going through, we don’t have injured children on our hands.” Obviously, this investigation is ongoing. “This was mid-block in a neighborhood, at 4:30 in the afternoon and children are there. They took a heck of a gamble for this particular house, and we’ve got to try to figure out why,” said Holmes. Without question, the 14-year-old boy in this story acted not only appropriately. but heroically. I’m not sure how many trained adults would have responded as well to this terrifying ordeal. The boy was smart to not open the door when the woman rang the doorbell, but that was a decision made under a relatively low degree of stress. Most parents would expect their 14-year-old child to make that decision. Where this kid’s grace under pressure took center stage is when he realized someone was trying to break through the front door. The boy first thought of protecting his younger siblings and did so by moving them upstairs, away from the threat. Next, the boy retrieved a handgun from his parent’s room, and when faced with a deadly threat, used the handgun appropriately to stop that threat. It’s not clear whether this very brave 14-year-old was relying purely in instinct or if he had received training. Either way, his actions saved the day. Police: Woman Shot Intruder 9 Times In Self Defense School Counselor Shoots, Kills Home Intruder The 53-year-old woman, who is also a veteran private school counselor, was alone at the time of the Wednesday morning attack. She lives on East Mount Tabor Circle in Duluth. The woman was getting out of the shower when she was met by a strange man with a kitchen knife, police said. They said there was a struggle in the bathroom, and she fell in the tub. Police later identified the man as Israel Perez Puentes, a Cuban national who lived in Alpharetta. "The male was armed with a kitchen knife, a struggle ensued between the two of them. She fell in the bathtub injuring herself," Gwinnett police spokesman Edwin Ritter said. The woman tried to fight the man off with a shower a rod, and he forced her into her bedroom, police said. They said she told her attacker she had money in the room. But she grabbed a .22-caliber handgun and shot the man nine times, police said. Police said the man ran out of a back door and collapsed in the yard. He later died at the Gwinnett Medical Center. The victim, who was injured in the scuffle, was also taken to the hospital for treatment of non-life-threatening injuries. Police have not released her name. Police told Channel 2's Kerry Kavanaugh they don't know why the woman was targeted. "He may have seen her somewhere and he identified her as being a potential victim and he basically stalked her until he found the right moment to act on it," said Ritter. "Our department is looking into any other cases around metro atlanta area as well as our jurisdiction to see if he may be involved with any other sexual assaults that may have occurred." Dan Tucker, a friend and neighbor, said he was amazed at how the victim defended herself against the armed intruder. "She's smart, she's witty and obviously well prepared," Tucker said. Ritter said the shooting investigation was ongoing but defended the victim, saying the shooting appeared to be justified, and that she acted in self-defense. He said there are no plans to charge her.
