This, of course, is a special kind of dumb. We have millions of people in jail; if your logic held, the jails would be empty. People do stupid shit all the time that sends them to jail and they do it for no reason at all.

Jail is presumably a deterrent, but arguing that "almost nobody does it" because they may end up in jail is sort of ridiculous.

This illogical nonsense has been extended by the left to absolute extremes: "We need not worry about how much such violations there are because there aren't many."

Which is the logical equivalent of, "We need not audit publicly held corporations because seldom do we catch any significant mistakes."
