In the UK the loser has to pay the winner's legal fees I believe. In any case there is a penalty for loosing a suit. Thousands of people employed by our legal system have cush jobs that produce nothing. 43% of congress are lawyers. Its not necessarily the patent system, its the tort system. Any unemployed lawyer can file a suit, it costs them virtually nothing. And it goes right through our society. The construction business is even worse. We've been sued on jobs we didn't even work on. I could tell you stories. You are pushing into the political so I'll just say that many folks in the world without legal recourse would trade positions every single day. It's not perfect but its the best there is in this world. Feel welcome to take this to PM.
