I believe they gave him a chance to surrender prior to sending in the tear gas. Even after sending in the tear gas he still could of come out, but he chose to stay inside. Reports are they heard a single gun shot after the tear gas went in and assumed he committed suicide.

Now if he surrendered and then shot him that would be a different story...
