He could have used his power as CIC. G-Bay is a military prison. Military decisions(like Bush starting the war in Iraqis) don't require Congressional approval anymore.

The responsibility lies not so much with the White House but with Congress, which has thwarted President Barack Obama’s plans to close the detention center

So Obama a promise to do something that was entirely out of his hands. Brilliant!
